Just why is $1.2 million such a big deal, anyway?

The Trump Taj Mahal lawsuit

Atlantic City, NJ: (Sep-23-07) Jean Ciocci, a 74-year-old woman, brought charges against Trump Taj Mahal Casino Resort, after she was injured as a result of one of the New Jersey resort's toilets collapsing. The suit claimed that the injury occurred when a handicapped-accessible toilet collapsed at the resort in 2004. The suit also alleged injuries that Ciocci suffered to her left arm during the toilet's collapse caused her to suffer another debilitating injury nearly two years later. Ciocci had lost her balance at a Pennsylvania social club on April 5, 2006, and was unable to break her fall due to her injury, the suit alleged. Ciocci broke her left humerus bone. In a settlement reached, Trump Taj Mahal Casino Resort agreed to pay Ciocci $1.2 million to resolve allegations. Taj Mahal did not accept responsibility for the accident, but settled to avoid the risks and costs of litigation.​

Did we mention the EEOC?

Back in 2010 EEOC now claims obesity is a disability under ADAAA.The U.S. Equal Employment Opportunity Commission (EEOC) now claims obesity is a disability under the Americans with Disabilities Act Amendments Act (ADAAA). Until now, the courts have routinely rejected general obesity as a “disability” under the ADA and Rehabilitation Act. Cases have required one to show some different underlying medical condition that is a disability and that causes obesity as a “symptom.”(SIC)  Read the rest of that by clicking here.

In the past twenty years there have been dozens of settlements and suits regarding broken toilets.  A quick search online bears this out.  And each settlement gets successively bigger as time passes.

The American Medical Association has officially recognized obesity as a disease, a move that could induce physicians to pay more attention to the condition and spur more insurers to pay for treatments. In making the decision, delegates at the association’s annual meeting in Chicago overrode a recommendation against doing so by a committee that had studied the matter."
